Recording Your Agreement
A settlement agreement is where the parties put their mutual agreement on paper.
For the Settlement Agreement to be enforceable, each party needs to obtain independent legal advice from his/her own lawyer.
The lawyer ensures the client:

understands the agreement;

is under no legal duress;

is legally able to sign the agreement; and
-
has the opportunity to ask questions and further understand their rights.
Advantages of having a Settlement Agreement:

Less expensive than going to court;

It can more accurately reflect the wishes and needs of the parties; and

Since it is an agreement (with independent legal advice), it can be enforced in court as a legally binding contract.
